Terms and conditions

1. Introduction
The General Terms and Conditions of the online store Shaperfection.com were written in compliance with the Consumer Protection Act. The Shaperfection.com website is managed by Herbamedis Limited, hereinafter: the provider. A user is a person who uses our system, i.e. a consumer in the online store, hereinafter: the consumer. The General Terms and Conditions of operations cover the operation of the online store Shaperfection.com, the rights of the consumers, and the business relationship between the provider and the consumer.

2. Order
After submitting an order the consumer receives an order confirmation sent to their email address within 24 hours. The consumer should announce their intention to cancel their order within 2 hours of submitting their order by writing to the provider’s email address info@shaperfection.com. In the event the consumer does not cancel their order, this means that an agreement on the purchase of the products has been concluded between the provider (Herbamedis Limited) and the consumer.

The agreement (order) is stored in electronic format on the provider’s server and is available to the consumer at any time by sending a request by email to info@shaperfection.com. In order to verify the data or ensure the accuracy of the delivery the consumer may call the provider to the contact phone number or contact them by email.

The list of technological means that make it possible to recognize and correct errors before submitting the order: The website Shaperfection.com offers just one (1) product, which makes the order transparent and highly simplified. The price and the quantity of the article are visible throughout the duration of the purchase. The purchase may be canceled easily.

3. Delivery time and delivery.
The provider packages the product and ships it in the promised time. In the event the order is submitted by 12 noon on a business day, the provider ships it on the same date. In the even the order is submitted after 12 noon, the provider ships it on the following business day. The delivery partner is DPD parcel delivery service. The official delivery date that DPD is obligated to meet is 3 days. In the event the consumer does not receive the parcel within 5 business days, they must inform Shaperfection of this by e-mail.

4. Shipping Costs
The lump sum cost of shipping is €6. 

5. Payment
The provider accepts one payment methods:

•    Payment by credit card using Paypal. Paypal is a payment method with VISA or Mastercard credit cards that provides 100% security for the customer.

6. Order Cancellation
The consumer should notify of a potential cancellation of the order within 2 hours of submitting the order to the provider’s email address. In the event the consumer does not cancel their order this means that the agreement on the purchase of the products between the provider and the consumer has been concluded.

7. Awareness of the Responsibility for Material Defect
As the seller, Herbamedis Limited, is responsible for delivering the goods to the consumer in accordance with the agreement, and is responsible for material or legal defects of its fulfillment.
A defect is a material defect if:
•    The item does not have the properties required for normal use
•    The item does not have the properties required for special use for which the consumer purchases it, but that the seller should know or should have known
•    The item does not have the properties or features that were explicitly or implicitly agreed or proscribed
•    The seller delivers an item that does not match the sample or model, unless the sample or model was shown only for notification purposes

The appropriateness of the goods for normal use is assessed with regard to usual goods of the same type and when taking into account any seller’s claims about the characteristics of the goods that the seller or manufacturer has given, especially through advertising, presentations, website presentations, or claims on the goods. Responsibility for material defects is assigned in accordance with the act that details obligation relations, unless such an act defines otherwise. The consumer may enforce their rights from material defects if they inform the seller within two months from the date the defect was discovered. The consumer may inform the seller of the material defect by email, phone call, or by writing to the seller’s address. The consumer must in such notification of material defect describe the defect in detail and if required make it possible for the seller to review the item. The consumer may also notify the seller of the defect in person, and the seller must issue a receipt of this event. A consumer who has correctly informed the seller of a defect has the right to request: replacement of the goods with the material defect with new, flawless goods, or reimbursement of the paid amount. If the existence of the defect on the goods or the irregularity in the rendered service is not contended, the seller must as soon as possible, but no later than within eight days, comply with the consumer’s request. The seller must respond to the consumer’s request in writing within eight days of its receipt if the existence of the defect on the goods or the irregularity in the rendered service is contended.

8. The Right to Withdraw from the Purchase and Return the Goods in Accordance with the Consumer Protection Act 
For all products in the online store warranty terms and conditions apply in compliance with the Consumer Protection Act. According to this Act the consumer has the right to inform the provider within fourteen days of receiving the goods that they are withdrawing from the agreement. They do not need to specify the reasons for doing so. At the same time the consumer is obligated to return the received goods to the provider’s address undamaged and in an unaltered quantity (as with delivery) within 14 days of submitting the notification on withdrawing from the agreement. The return of the delivered goods to the provider within 14 days of receiving it without sending a notification on withdrawing from the agreement is also deemed a notification on withdrawing from the agreement. The purchase fee and any other remaining payments are to be returned by the provider in full within 14 days of receiving the notification on withdrawing from the agreement.

9. Prices
Product prices are in euros. The prices are valid at the moment of submitting the order, and do not have an expiration date. Prices may change without prior notice. The offer is available while supplies last. 

10. Discharge from Obligation
The provider is not responsible for the content of opinions on products written by website users. The opinions and ratings of the product are those of each individual, and do not necessarily represent the opinion of the editorial board of the shaperfection.com website.
Even though the provider strives to ensure accurate photos of sales articles, all photos should be deemed symbolic. Photos do not ensure the product’s features.
The provider retains the right to change these Terms and Conditions at any time and in any way, regardless of the reason and without prior notification.

11. Personal Data Protection
The provider undertakes to permanently protect all users’ personal data in accordance with the Personal Data Protection Act. The provider shall use the personal data exclusively for the requirements of fulfilling the order (sending promotional materials, offers, invoices), and all other required communication. Users’ data shall in no event be handed over to unauthorized persons. The provider uses appropriate technological and organizational means for protecting and storing personal data and payments. The provider uses a 128-bit SSL certificate.

12. Complaints and Disputes
The provider adheres to the valid legislation on consumer protection, and is obligated to establish an effective system for complaint resolution. In the event of an issue, the consumer may turn to the provider by email or in writing to the corporate address. The provider shall within five business days confirm that it received the complaint and shall notify the consumer of further procedures. The provider strives to its full extent to resolve any potential disputes with a mutual agreement.
